1. General Terms

These Terms & Conditions govern the use of the BayServe Legal website and, when incorporated into an accepted service agreement, the legal support services provided by BayServe Legal.

By requesting and authorizing services under an agreement incorporating these terms, clients acknowledge the applicable service conditions and payment obligations.

2. Services Provided

BayServe Legal provides professional legal support services, including process serving, legal courier services, and stakeouts associated with locating or serving individuals.

All services are subject to availability, applicable laws, assignment requirements, and written acceptance by BayServe Legal.

3. Client Responsibilities

Clients are responsible for providing accurate and complete assignment information, including recipient identification, addresses, legible legal documents, applicable deadlines, and relevant service instructions.

Clients are responsible for ensuring the legal sufficiency of documents and determining the service requirements applicable to their proceedings.

Incomplete, inaccurate, or delayed information may affect assignment timeframes, costs, or completion.

4. Service Attempts and Documentation

Process-serving assignments generally include up to three attempts unless otherwise agreed upon.

Attempts are scheduled according to the circumstances of the assignment, available information, and reasonable prospects of successful service.

Substituted service may be performed only when legally permitted and consistent with applicable instructions.

BayServe Legal documents service attempts, including relevant dates, times, locations, and photographs.

Completed proofs of service, affidavits, or non-service documentation will be provided as appropriate.

BayServe Legal provides completed proof documents to clients but does not file proofs of service with the court. Clients are responsible for any required filing.

5. No Guarantee of Successful Service

BayServe Legal exercises reasonable professional efforts to complete authorized assignments.

However, successful service, recipient availability, and completion by a particular deadline cannot be guaranteed.

Factors such as inaccurate addresses, restricted access, recipient avoidance, safety concerns, or circumstances beyond our control may affect service outcomes.

6. Legal Courier and Stakeout Services

Legal courier assignments are performed according to accepted delivery instructions and applicable operational requirements.

Stakeout assignments are subject to agreed minimum service periods, location conditions, safety considerations, and applicable legal restrictions.

Unless otherwise agreed, stakeout assignments require a four-hour minimum.

No guarantee is made that an individual will appear or be located during an observation period.

7. Fees, Payments, and Cancellations

All service fees, payment requirements, additional charges, and cancellation conditions are governed by BayServe Legal's published Payment Terms and any accepted written quote or service agreement.

Where the specific terms of an accepted written quote differ from general published pricing, the accepted quote governs that assignment.

8. Confidentiality and Information Handling

BayServe Legal treats legal documents, assignment instructions, and related personal information as confidential business information.

Information may be disclosed to authorized personnel, service providers, and other appropriate parties when reasonably necessary to perform the assignment or comply with applicable law.

9. Assignment Acceptance and Withdrawal

BayServe Legal reserves the right to decline an assignment before acceptance.

An accepted assignment may be suspended or terminated when continued performance would create material safety concerns, involve unlawful or misleading instructions, or become impracticable because of circumstances beyond our reasonable control.

Any amounts due or refundable will be determined according to the applicable service agreement, work performed, and law.

10. No Legal Advice

BayServe Legal is a legal support service provider and does not operate as a law firm.

We do not provide legal representation or legal advice.

Clients should consult a licensed attorney regarding legal strategy, filing obligations, service deadlines, and interpretation of applicable laws.

11. Limitation of Liability

To the extent permitted by applicable law, BayServe Legal is not responsible for indirect or consequential losses arising from circumstances outside its reasonable control, including delays caused by inaccurate client instructions, unavailable recipients, or restricted access.

Any additional limitation of liability applicable to a paid assignment must be included in an enforceable service agreement.

Nothing in these terms excludes liability or rights that cannot lawfully be limited.

12. Website Content

Website content is provided for general informational purposes.

While we make reasonable efforts to maintain accurate information, website descriptions do not guarantee service availability, a particular outcome, or acceptance of any assignment.

13. Applicable Law

These terms are governed by applicable California law, subject to any mandatory rights and protections available under other applicable laws.

14. Changes to These Terms

BayServe Legal may update these Terms & Conditions periodically.

Changes posted on the website do not retroactively modify an accepted service agreement unless lawfully agreed upon by the parties.
